Tomos — Terms of Service

These Terms of Service ("Terms") are a contract between you and [Company Legal Name] ("Tomos", "we", "us") governing your use of the Tomos mobile app and related services (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be the age of majority in your province or territory of residence (or have the consent of a parent or legal guardian) and be able to form a binding contract. The Service is intended for adults.

2. The Service

Tomos lets you scan receipts, automatically extract structured data from them (merchant, date, totals, taxes, line items), review and edit that data, see price history and trends across your own receipts, and export your data to common formats. Features and limits may differ by plan (free, Pro) and by your credit balance.

Extraction is automated and may be inaccurate. Tomos uses optical character recognition and AI to read receipts; results can contain errors or omissions. You are responsible for reviewing and correcting extracted data before relying on it. Tomos does not provide accounting, tax, legal, or financial advice, and the Service is not a substitute for professional advice or for your own records.

3. Your account

You are responsible for the activity under your account and for keeping your sign-in method secure. Notify us at support@tomos.app if you believe your account has been compromised. You may delete your account at any time from Settings → Delete account (see our Privacy Policy for how deletion works).

4. Plans, credits, and billing

• Subscriptions and credits are sold through Stripe and, on Android, through Google Play Billing. By purchasing, you authorize the applicable processor and store to charge you.
• Subscriptions renew automatically for successive periods until cancelled. You can cancel at any time; cancellation takes effect at the end of the current billing period, and you keep access until then.
• Manage or cancel a Google Play subscription through your Google Play account; manage other billing as described in the app.
• Refunds are handled according to the policies of the applicable store or processor (e.g., Google Play) and applicable law. Except where required by law, fees are non-refundable and credits are non-transferable and have no cash value.
• We may change prices or plan features prospectively; we will give notice where required, and changes do not affect a billing period already paid.

5. Acceptable use

You agree not to:

• use the Service unlawfully or to upload content you have no right to upload;
• attempt to disrupt, overload, reverse-engineer, or gain unauthorized access to the Service or its infrastructure;
• resell or commercially exploit the Service except as expressly permitted;
• use automated means to access the Service outside features we provide.

We may suspend or terminate accounts that violate these Terms or that create risk or legal exposure for us or others.

6. Your content

You retain ownership of the receipt data and other content you create in the Service ("Your Content"). You grant us a limited licence to host, process, display, and back up Your Content solely to operate and provide the Service to you (including sending receipt images to our extraction provider as described in the Privacy Policy). You are responsible for Your Content and for keeping your own copies of anything important to you.

7. Intellectual property

The Service itself — software, design, trademarks, and content other than Your Content — belongs to us or our licensors. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service in accordance with these Terms. "Tomos" and our logos may not be used without our permission.

8. Third-party services

The Service relies on third parties (e.g., Google, Apple, Stripe, Resend, our hosting provider). Your use of those services may be subject to their own terms, and we are not responsible for them.

9. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that extracted data will be accurate or complete. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.

10. Limitation of liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us for the Service in the 12 months before the claim, or CAD $50. Nothing in these Terms limits liability that cannot be limited under applicable law.

11. Indemnity

You agree to indemnify and hold us harmless from claims, losses, and expenses (including reasonable legal fees) arising from your misuse of the Service or your breach of these Terms, to the extent permitted by law.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if continuing to provide the Service becomes impractical. Sections that by their nature should survive termination (e.g., 6–11, 13) will survive.

13. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-laws rules. You and we submit to the courts located in Ontario, subject to any mandatory consumer-protection rights in your place of residence.

14. Changes to these Terms

We may update these Terms from time to time. We will revise the "Last updated" date and, for material changes, provide more prominent notice. Continued use of the Service after a change takes effect means you accept the updated Terms.
